This disclaimer applies to the website foresain.com, the access-restricted client portal app.foresain.com, and all assessments and reports produced or provided through the platform ("Foresain reports") by CRAiD GmbH, Kollwitzstr. 60, 10435 Berlin, Germany ("Foresain"). By using the website, by signing in to the client portal, or by accessing or receiving a Foresain report, you accept this disclaimer. Every Foresain report references this page.
Foresain reports are structured, indicator-based assessments of publicly available sources only, as of the stated cut-off date, prepared following the methodology of DIN SPEC 33456 (GDIS). Maturity levels, scores, bands and red flags are evaluative judgements on a documented factual basis: every underlying source is preserved at collection time as a versioned snapshot with a SHA-256 checksum and listed in the report's evidence register. Facts that cannot be evidenced are reported as information gaps, never estimated.
Foresain is not a statutory auditor and not an "official auditor": Foresain reports are not a statutory audit within the meaning of sections 316 et seq. of the German Commercial Code (HGB), not an audit review, not an engagement under professional auditing standards (IDW, ISA), and do not originate from any publicly appointed, chartered or professionally licensed audit or supervisory body. They do not replace any legally required audit, attestation or certification and do not constitute an audit opinion or any comparable statement. Foresain assessments rest exclusively on verifiable, documented information: every assessment-relevant fact is traceable to a checksummed source listed in the evidence register — anything that cannot be evidenced is reported as an information gap and is not scored.
Foresain reports are furthermore not a credit rating within the meaning of Regulation (EC) No 1060/2009, not a credit report or creditworthiness assessment, and make no statement about any company's solvency. They are not legal, tax or investment advice and no recommendation to buy or sell financial instruments or to enter into any transaction.
Collection is partially automated from public sources. Public sources may be incomplete, outdated or erroneous; not every relevant fact is publicly available or discoverable at the cut-off date. Foresain therefore gives no warranty as to the completeness, accuracy or currency of the sources assessed or the judgements derived from them. Every report is a snapshot as of its stated cut-off date. Internal or non-public information of assessed companies is not used.
Foresain reports support — and do not replace — the independent judgement of professional users (boards, investors, insurers, advisors). Decisions taken on the basis of Foresain reports are your own responsibility. Before material decisions, consult the underlying primary sources (linked in the evidence register) and, where appropriate, professional advisors.
Foresain is liable — on whatever legal grounds — only for intent and gross negligence. In cases of slight negligence, Foresain is liable only for breaches of material contractual obligations (cardinal duties), limited to the foreseeable damage typical for the contract. These limitations do not apply to damage arising from injury to life, body or health, or to claims under the German Product Liability Act.
Foresain assesses exclusively on the basis of public sources evidenced in the report. If an assessed company considers that a report rests on an incorrect, outdated or incomplete source base, it may contact hello@foresain.com. Substantiated objections are reviewed promptly; if a source error is confirmed, the report is re-issued in corrected form and marked as such towards its recipients.
Foresain reports are intended for the internal use of the respective client. Passing a report to third parties is permitted only in full, unmodified and including the reference to this disclaimer.
Reports and website link to external sources (annual reports, register pages, press). Their providers are solely responsible for their content; the version preserved in the evidence register at collection time is authoritative.
Foresain may amend this disclaimer with effect for the future; the version published at the time of use or report creation applies. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
